The Board convened Monday, October 13, 2003 at 11:20 a.m. after the meetings of the various Board Committees. All Directors were present. The Chief Operating Officer and Executive Secretary were also present.
The Board reviewed the August 2003 minutes. Upon motion made by Dr. Battaglia and seconded by Mrs. Strand, the minutes of the August 2003 meeting, copies of which were made available to all Directors, were adopted (unanimously).
The Chairman, Mr. Menaker, reported on the donation of a bronze DOGNY statue to the Hartz Mountain Company in recognition of their support of the AKC CAR Canine Support and Relief Fund. The Hartz Mountain Corporation is planning to debut, shortly, the 2004 edition of the Hartz DOGNY "Help a Hero" toy. Last year�s toy raised over $811,000 for the AKC CAR Canine Support and Relief Fund. This year�s program incorporates the same financial model with one dollar from each sale to be donated to the AKC CAR Canine Support and Relief Fund. The latest versions of the toy represent two search and rescue dogs, Scout and Ranger. The toy is now an annual collectible, with new "characters" to be developed each year.
Outside consultants, Charley Kneifel and Terry Cook gave presentations on Web Analysis and the Registration System, respectively.
Mr. Menaker gave an update on the AKC/Eukanuba National Championship show. The Long Beach school system is sponsoring an art contest tied to the event and some of the artwork will be on display during the show. There have also been over 130 entries in the contest for a commemorative poster that will be produced. The proceeds from sales of the poster will go to the AKC CAR Canine Support and Relief Fund. There will be 110 vendors and 140 Parent Clubs are participating in the Meet the Breed display.
The President, Mr. Cheauré, reported on the status of the registration system.
Mr. Cheauré reported on some staff reorganization. Noreen Baxter will be relocating to the New York office. In addition to her current duties, she will oversee the entire Communications area including Internet Services, Publications, and Marketing.
Mr. Sprung reported on a significant art contribution to AKC from Mr. Tom Stevenson. It includes three gold washed sterling pendants, painted on ivory, for Mrs. Sherman Hoyt and four Muss-Arnolt oils of Windholme Beagles, painted for Mr. Harry Peters.
Following a motion by Mr. Merriam, seconded by Mr. Menaker, it was VOTED (unanimously) to extend Mr. Stevenson the Board�s sincere appreciation for his generous gift.
Mr. Stevens gave a financial report as follows:
The month of September 2003 produced total revenues of $4.6 million compared to $4.7 million last year. The net deficit for the month was $594,000.
September�s dog registrations were 77,034 vs. 77,029 last year. Litter registrations of 34,190 were 4.4% lower in comparison to 35,745 last year.
Year-to-date revenues for the first nine months of 2003 were $44.3 million vs. $44.6 million last year. The year-to-date 2003 net deficit was $1.8 million. This compares unfavorably to the budgeted deficit of $585,000 and a $250,000 surplus generated last year.
The Executive Secretary, Mr. Crowley, reported on a proposed amendment to ARTICLE XV, SECTION 4 of the AKC Bylaws, which is reprinted as Chapter 8, Section 4 of the Rules Applying to Registration and Discipline. The amendment would provide that AKC clubs could hold non-AKC events with AKC permission. The matter was to be considered further in November.
The Board reviewed a recommendation from AVMA concerning health requirements for dogs attending AKC events. It also considered input from the Delegate Canine Health Committee, which instead suggested a more general premium list statement. This was discussed by the Board and the matter referred to the Board Events and Clubs Committee.
The Board�s February 2004 meeting was scheduled for Friday and Saturday, February 6-7, 2004.
Mr. Crowley reported on a meeting held between representatives of AKC and FCI in August. A draft letter of understanding, defining the relationship between the two organizations was being developed.
The Board discussed the proposed Working Dog Sport and opinions expressed by Delegates and others concerning it. Following a motion by Mr. Gladstone, seconded by Dr. Mays, it was VOTED (unanimously) to refer the matter to the Board Events and Clubs Committee for review and consideration of the input received. Should that committee feel it is appropriate, it could recommend the formation of a Board-appointed committee to study and make recommendations on the questions and issues raised.
Mr. Merriam, Mr. Marden, and Dr. Haines, members of the Appeals Committee, left the meeting prior to the report on Judges Applications.

The Board reconvened Tuesday, October 14, 2003, at 8:00 a.m. All Directors were present. The Chief Operating Officer and Executive Secretary were also present.
There was a report on the actions taken by the AKC staff during the month of April 2003 on the cancellation of litters and individual registrations.
During the month of September, the registrations of 34 litters were cancelled: 8 because of impure breeding and 26 as a result of DNA Parentage Evaluation.
The cancellation of the 34 litters resulted in the cancellation of 58 registered dogs and rendered 124 dogs, members of these litters, ineligible for registration.

Mr. Goodman gave the report for the Board Breeders� Committee. The committee was reviewing material prepared by the Ad Hoc Breeders� Committee previously appointed by the Board. It was also discussing information for first-time breeders.
Dr. Davies gave the Events and Clubs Committee Report on fines assessed clubs for late submission of date applications and judges panels.

There was a discussion on Delegate eligibility. The Chairman, with the concurrence of the Board, directed staff to prepare a report and recommendations on the Bylaw restrictions on Delegate eligibility.
The Board considered a proposed amendment to Chapter 3, Section 22 of the Rules Applying to Dog Shows, which would provide for more meaningful competition in the Miscellaneous Class. Following a motion by Mr. Marden, seconded by Mr. Goodman, it was VOTED (unanimously) to present the change to the Delegates in December 2003, for a March 2004 vote, which would amend Chapter 3, Section 22 to read as follows:
CHAPTER 3, SECTION 22. The Miscellaneous Class shall be for purebred dogs of such breed as may be designated by the AKC Board of Directors. No dog shall be eligible for entry in the Miscellaneous Class unless the owner has been granted an AKC identification number, and unless the AKC identification number is given on the entry form. Application for an AKC identification number shall be made on a form provided by the AKC and when submitted must be accompanied by a fee set by the Board of Directors.The regular Miscellaneous Classes for each breed shall be Puppy and Open, with the same eligibility requirements in Sections 4 and 9 of this Chapter respectively. These classes shall be divided by sex. All class winners within a breed shall compete for Best of Breed and Best of Opposite Sex to Best of Breed.
Each of the Miscellaneous Class Best of Breed winners shall be eligible to compete for Best in Miscellaneous Class. All entries for Best in Miscellaneous Class shall be made after judging of the individual Miscellaneous breed classes and no entry fee shall be charged. In the event that the owner of a dog designated Best of Breed shall not exhibit the dog in the Best of Miscellaneous Class Competition, no other dog of the same breed shall be allowed to compete. There shall be no further competition for dogs entered in the Miscellaneous Class.
The ribbons shall conform to Chapter 5, Section 2 of these rules and shall be the following colors:
First Prize - RoseSecond Prize - Brown
Third Prize - Light Green
Fourth Prize - Gray
Best of Breed - Orange
Best of Opposite - Lavender
Best in Miscellaneous - Pink and Green

Ms. Scully informed the committee of her assessment of and recommendations for improvement, sent to various staff members regarding issues related to obedience information on the AKC website.
The Board considered requests from the Standard Schnauzer Club of America and Giant Schnauzer Club of America to permit those breeds to participate in AKC�s Herding program. Both clubs submitted documentation detailing the breeds� development as Herding breeds. Following a motion by Ms. Scully, seconded by Dr. Davies, it was VOTED (affirmative, Ms. Scully, Dr. Davies, Mr. Marden, Mr. Menaker, Mrs. Schaefer, Mrs. Strand, Dr. Haines, Dr. Garvin, Mr. Gladstone, Mr. Goodman, Dr. Mays, Dr. Battaglia; abstaining, Mr. Merriam), effective January 1, 2004, to amend Chapter 1, Section 3 of the Herding Regulations as follows:
Chapter 1, Section 3:
All dogs nine (9) months of age or older that are registered with The American Kennel Club and classified as Herding Dogs under Chapter 1 of the Dog Show Rules, Samoyeds and Rottweilers and Herding breeds eligible to compete in the conformation Miscellaneous Class, are eligible to participate in herding tests and trials.
All dogs, nine (9) months of age or older, classified as Herding Group dogs under Chapter 1 of the Dog Show Rules, Samoyeds and Rottweilers and Herding breeds eligible to compete in the conformation Miscellaneous Class, that have been granted an Indefinite Listing Privilege (ILP) may participate in herding tests and trials.
Standard Schnauzers and Giant Schnauzers nine (9) months of age or older that are registered with The American Kennel Club, or have been granted Indefinite Listing Privilege (ILP) may participate in herding tests. Standard Schnauzers and Giant Schnauzers nine (9) months of age or older that are registered with The American Kennel Club, or have been granted Indefinite Listing Privilege (ILP) shall be allowed to enter herding trial classes as Exhibition Only Entries as specified under Ch. 1, Section 12, part (D).
The Board considered placing Florida back in Point Schedule Division 4, where it had been prior to this year. Following a motion by Mr. Menaker, seconded by Mr. Goodman, it was VOTED (affirmative, Mr. Menaker, Mr. Marden, Mr. Goodman, Mrs. Strand, Ms. Scully, Mrs. Schaefer, Dr. Battaglia, Dr. Mays, Dr. Davies; opposed, Mr. Merriam, Dr. Haines, Mr. Gladstone, Dr. Garvin) to consider the matter at this meeting, waiving the usual prior notice requirement.
Following a motion by Mr. Marden, seconded by Mr. Goodman, it was VOTED (affirmative, Mr. Marden, Mr. Goodman, Dr. Davies, Mr. Menaker, Mr. Merriam, Dr. Haines, Ms. Scully, Mrs. Strand, Mrs. Schaefer, Dr. Battaglia, Dr. Mays; opposed, Mr. Gladstone, Dr. Garvin) to place Florida in Division 4, effective with the May 2004 Point Schedule.
The Board discussed the implementation of Rally as an AKC event. Following a motion by Dr. Garvin, seconded by Ms. Scully, it was VOTED (unanimously) to approve the concept of the Rally program and to incorporate Regulations governing Rally into the Obedience Regulations. The Regulations will be reviewed by the Board in November.
The Events and Clubs Committee also discussed: breed standard revisions, the addition of the Neapolitan Mastiff to the Working Group, adding the Cesky Terrier to breeds eligible for Earthdog tests, a Walking Gun Dog Championship for German Shorthaired Pointers, and editorial and substantive amendments to the Obedience Regulations based upon recommendations of the Obedience Advisory Committee. Among the changes are: two trials in a day by one club, all-breed trials for specialty clubs, same day move-ups, an entry waiting list, making Pre-Novice a Non-Regular Class, new Non-Regular Graduate Novice and Graduate Open Classes.
The Board discussed the controversy surrounding the cancellation of a number of Herding Championships due to a difference of opinion on how the regulations should be interpreted. Following a motion by Ms. Scully, seconded by Dr. Davies, it was VOTED (affirmative, Ms. Scully, Dr. Davies, Dr. Battaglia, Mrs. Strand, Mrs. Schaefer, Mr. Gladstone, Dr. Garvin, Dr. Mays, Mr. Goodman, Mr. Marden, Mr. Menaker, Dr. Haines; abstaining, Mr. Merriam) to have the Chairman appoint a broad-based committee to review the matter in Long Beach in connection with the December Delegates meeting.
Mr. Merriam gave the report from the Business Committee.
The Board considered input from the Dog Show Superintendents Association concerning the licensing fees adopted by the Board in August. The superintendents proposed an alternate fee system, which would produce the identical revenue. Their proposal would set all renewal fees at $100 (primary superintendents and superintendents in the employ of a primary), and imposes a per event superintendent fee. There was a motion by Mr. Merriam, seconded by Mr. Menaker to adopt an annual license fee of $100 on all superintendents (primary and in the employ of a primary) plus $10 for each titling event superintended in the previous year. There was a motion by Mr. Gladstone, seconded by Dr. Mays, to make the per event fee $25. This amendment was defeated with the VOTE (affirmative, Mr. Gladstone, Dr. Mays; opposed, Mr. Merriam, Mr. Menaker, Ms. Scully, Mrs. Strand, Dr. Battaglia, Dr. Davies, Mr. Goodman, Dr. Haines, Mrs. Schaefer, Mr. Marden, Dr. Garvin). The main motion was then adopted (unanimously). The fee schedule for event secretaries will remain as approved in August 2003.
The committee also discussed AKC event television rights and received a report on the performance of Family Dog Magazine.
Dr. Battaglia gave a report from the Operations and Planning Committee.
The Board considered restricting the use of discontinued prominent kennel names even if the names have never been registered. Such restriction would be based upon a request from a breed Parent Club and it would be breed-specific. Following a motion by Mrs. Strand, seconded by Mrs. Schaefer, it was VOTED (affirmative, Mrs. Strand, Mrs. Schaefer, Mr. Menaker, Mr. Merriam, Mr. Goodman, Dr. Battaglia, Dr. Haines, Dr. Garvin, Ms. Scully, Mr. Marden, Mr. Gladstone; opposed, Dr. Davies, Dr. Mays) to approve the restriction on the use of non-registered kennel names, effective June 1, 2004, as follows:
The use of an unregistered kennel name may be restricted on a breed-specific basis provided:
- That the request comes from the Board of a Parent Club.
- That the historical significance of the name to a breed is demonstrated.
- That it has been determined by the Parent Club, as far as possible, that no other party has a claim to the use of the name.
The Board considered the restriction of certain kennel names that had never been registered. The requests were submitted by Parent Clubs and had been pending the adoption of a Board Policy concerning non-registered kennel names. Following a motion by Dr. Battaglia, seconded by Mr. Goodman, it was VOTED (affirmative, Dr. Battaglia, Mr. Goodman, Mr. Marden, Mr. Merriam, Mr. Menaker, Mrs. Schaefer, Mrs. Strand, Ms. Scully, Dr. Haines, Mr. Gladstone, Dr. Garvin, Dr. Davies; opposed, Dr. Mays) to place a breed-specific restriction on the following kennel names, effective June 1, 2004:

There was discussion on a proposed amendment to Chapter 3, Section 7 of the Rules Applying to Registration and Discipline which on a limited basis would permit a change in name for a registered dog. Following a motion by Mr. Gladstone, seconded by Dr. Battaglia, it was VOTED (unanimously) to have the following amended wording for Chapter 3, Section 7 read at the December 2003 meeting for a vote in March 2004:
Chapter 3, Section 7:
A one-time change in the name of a dog whelped in the United States, and registered with The American Kennel Club will be permitted. However, no change in name will be recorded by the AKC after the dog has produced or sired an AKC registered litter or received an award at an AKC licensed or member event. If the dog was first registered by the breeder(s) of record, the breeder(s) must agree to any change in name. Any change in name must comply with all AKC requirements.
There was a discussion on the arbitration language that is to appear on AKC entry forms. The original language included arbitration claims with the event-giving club that could be deleted if the club opted out of the arbitration process. Rather than having two types of entry forms, there was a proposal to have one form. If a club does not wish to participate, it must so indicate in its premium list. Following a motion by Mr. Gladstone, seconded by Dr. Battaglia, it was VOTED (unanimously) to require the following wording on all entry forms for AKC events, effective April 1, 2004:
"I (we) agree that any cause of action, controversy or claim arising out of or related to the entry, exhibition or attendance at the event between the AKC and the event-giving club (unless otherwise stated in its premium list) and myself (ourselves) or as to the construction, interpretation and effect of this Agreement shall be settled by arbitration pursuant to the applicable rules of the American Arbitration Association. However, prior to arbitration all applicable AKC Bylaws, rules, regulations and procedures must first be followed as set forth in the AKC Charter and Bylaws, rules, regulations, published policies and guidelines."
The committee also discussed adding the registry in Luxembourg to the list of organizations with pedigrees acceptable for AKC registration, the registration of American Eskimo Dogs whelped in Canada, and recommendations based upon the DNA Advisory Committee report.
Mrs. Strand gave a report from the Public Relations and Public Affairs Committee.
There was a discussion on staffing in the Compliance area. Following a motion by Ms. Scully, seconded by Mrs. Strand, it was VOTED (affirmative, Ms. Scully, Mrs. Strand, Mr. Menaker, Dr. Garvin, Dr. Battaglia, Mrs. Schaefer, Mr. Marden, Mr. Merriam, Dr. Mays, Mr. Gladstone, Mr. Goodman, Dr. Davies; abstaining, Dr. Haines) to authorize the filling of two inspector positions in 2004, one of which would be assigned to a pet shop oversight pilot program.
The committee discussed recommendations from the High Volume Breeders Committee. The AKC booth schedule, initiatives to increase the membership of local dog clubs, AKC Responsible Dog Ownership Day results, homeowners insurance, and breeder referral.
Mrs. Strand reported that Gail Miller has joined the AKC staff to fill the Spokesperson /Director of Media Relations position. In addition to a BS and MA in communications, and extensive experience in the television field, she also has over 25 years experience in dogs as a breeder and an exhibitor in conformation, obedience, and herding events.
There was discussion on what should be recorded in the Board minutes. The consensus is that it should, as much as possible, be limited to Board actions and reports of Board Committee actions rather than reports of staff accomplishments in areas like public relations, events, and legislation. It was suggested that these non-Board action items be included in AKC highlight releases rather than in the minutes.
The Board considered a proposal from MBF that would provide for a check-off on entry forms, whereby exhibitors would voluntarily donate $1.00 to the AKC Canine Health Foundation. Entrants who make this donation would have a star placed next to the dog�s name in the catalog. Before considering the matter further, staff was directed to get the input of the superintendents� association.
