The Board convened Monday, August 11, 2003 at 11:20 a.m. after the meetings of the various Board Committees. All Directors were present. The Chief Operating Officer and Executive Secretary were also present.
The Board reviewed the July 2003 minutes. It was noted that the motion to consider the Schutzhund Policy at the July 2003 meeting was made by Dr. Davies. The motion to adopt the revised policy was made by Dr. Battaglia and seconded by Dr. Haines. The policy should begin "Any Parent Club...." Upon motion made by Dr. Haines and seconded by Dr. Davies, the minutes of the July 2003 meeting, copies of which were made available to all Directors, were adopted as amended (unanimously).
There was an Executive Session to discuss personnel matters.
The Chairman, Mr. Menaker, reported on the AKC/Eukanuba National Championship show.
Mr. Menaker outlined a proposal for a voluntary check-off on entry forms for a $1.00 donation to the AKC Canine Health Foundation. This is already being done by some clubs and staff was directed to explore extending this to all shows.
Mr. Merriam gave the report from the Business Committee.
The Board considered the licensing fees paid by AKC superintendents and the institution of a fee for event secretaries that handle over a certain number of events in a year. Following a motion by Mr. Merriam, seconded by Mr. Gladstone, it was VOTED (unanimously) to enact the following:
Effective January 1, 2004, the annual license fees paid by a Primary Superintendent or Superintending Organization will be based upon the number of events superintended in the previous year per the following schedule. The same schedule would apply to Event Secretaries.

Superintendents in the employ of a Primary Superintendent will pay an
annual fee of $100.

The committee also discussed AKC involvement in the televising of and other media exposure for AKC events.
The President, Mr. Cheauré, reported on the timetable for the implementation of the redesigned registration system. Testing was scheduled to begin on August 12, 2003, with the system going live on October 1, 2003.
Mr. Cheauré gave a report on a comparison of 2003 litter and dog registration numbers vs. revenue as well as June and July registration trends.
Mr. Cheauré gave an update on the projects undertaken by the Internal Consulting Group. They include: an Electronic Litter Kit that will convert the litter kit delivery mechanism from paper to an electronic format; combining the mailing of pedigrees and registration certificates together in one envelope to cut costs and to provide better service; and an online extension of the AKC GAZETTE's popular Breeders' Classifieds.
Mr. Cheauré read the following statement, which was being sent to all employees:
"The Board has accepted my offer to step down as President/CEO of the American Kennel Club effective December 31, 2003.
My primary goal when I accepted this position was to complete the process of change that was necessary to secure our future. Since this will be accomplished before year's end, it is the appropriate time for me to step down and make contributions to the sport in other meaningful ways.
I intend to remain active as a Delegate and also participate in the sport and with the clubs of which I am a member.
It has been a pleasure to serve as your President/CEO over the past seven years and I have every confidence that you will continue to move the AKC forward.
Patricia and I thank you for your support and friendship."
Mr. Menaker expressed the Board's appreciation for Mr. Cheauré's years of dedication. Mr. Merriam also expressed his gratitude to Mr. Cheauré for working closely with him for the five and a half years that he was Chairman.
The Chief Operating Officer, Mr. Sprung, gave an update on construction in the North Carolina Operations facility. The installation of the Canine Health Foundation, the relocation of Companion Animal Recovery, and the expansion of registration have all been completed for $234,998.28, which was $119,209.41 under budget.
The Chief Financial Officer, Mr. Stevens, gave a financial update.
The month of July 2003 yielded total revenues of $5.3 million compared to $5 million last year. The net deficit for the month was $386,000.
July's dog registrations were 81,223 vs. 80,432 last year. The month's litter registrations were 38,133 compared to 41,374 last year.
Year-to-date revenues for the first seven months of this year totaled $35 million vs. $37 million per the 2003 budget and $35.3 million last year. The 2003 year-to-date deficit is $1.3 million. This compares unfavorably to a budgeted surplus of $59,000 and a $1.5 million surplus for the comparable period last year. Lower 2003 registration revenues and an increased pension expense were the major factors contributing to these results.
The Executive Secretary, Mr. Crowley, reported on a recommendation from the AVMA concerning health requirements for dogs brought onto show grounds including a certification that dogs have updated vaccinations and are parasite free. This was to be reviewed further.
Following a motion by Dr. Battaglia, seconded by Mr. Gladstone, it was VOTED (unanimously) to plan for a Board Retreat on August 20-23, 2004.
The Board agreed that in November 2003, there would be a three-day Board meeting.

The Board considered a proposed amendment to ARTICLE XVIII, SECTION 1 of the AKC Bylaws, submitted by the Beaumont Kennel Club. The amendment would leave the regularly scheduled meetings in March, June, and September, but give the Board the flexibility to schedule a fourth meeting at any other time with a six-month prior notice to the Delegates. Following a motion by Dr Battaglia, seconded by Mr. Merriam, it was VOTED (affirmative, Dr Battaglia, Mr. Merriam, Mr. Menaker, Mr. Marden, Dr. Davies, Mr. Goodman, Mrs. Strand, Mrs. Schaefer, Ms. Scully, Dr. Mays, Mr. Gladstone, Dr. Garvin; opposed, Dr. Haines) to approve the following amendment to be read in September 2003, for a December 2003 vote:
Article XVIII, Section 1. The annual meeting of the AKC shall be the regular meeting held in March. There shall also be regular meetings of the AKC in June and September. There shall be one unscheduled meeting to be determined by the Board. The exact date, time and location of all meetings shall be determined by the Board of Directors with the exception that the unscheduled meeting shall be determined 6 months in advance.
The Board discussed the location for the June 2004 Delegates meeting. Following completion of the report on Judges Applications, Mr. Merriam, Mr. Marden and Dr. Haines returned to the meeting.
Mr. Merriam gave the report for the Appeals Committee. The committee, consisting of Mr. Merriam and Dr. Haines, heard the appeal of John Chokran, whose judging privileges were suspended for three years at the July 2003 Board meeting. The committee recommended that this decision be reversed. It was VOTED (abstaining, Mr. Marden) to adopt this recommendation and to immediately reinstate Mr. Chokran's judging privileges.
There was a report on the actions taken by the AKC staff during the month of July 2003 on the cancellation of litters and individual registrations.
During the month of July the registrations of 32 litters were cancelled: 6 because of impure breeding and 26 as a result of DNA Parentage Evaluation.
The cancellation of the 32 litters resulted in the cancellation of 50 registered dogs and rendered 106 dogs, members of these litters, ineligible for registration.

Specifically, Mr. Hoeme was charged with violation of AKC Hunt Test Regulations and Guidelines for Retrievers. Mr. Hoeme had an electric collar on the dog. The AKC Management Disciplinary Committee acted to issue a public reprimand and imposed a $100 fine.
Gerald and Geri Jacobs (Savannah, GA) were charged by the Clemson Kennel Club for conduct at their event on June 22, 2003. Specifically, Mr. and Mrs. Jacobs were charged with failure to properly control a dog at an event. Mr. and Mrs. Jacobs were not in proper control of their three Bulldogs and they attacked a Doberman Pinscher. The AKC Management Disciplinary Committee acted to issue a public reprimand and impose a $200 fine.
The AKC's Management Disciplinary Committee has suspended the following individuals from all AKC privileges for a period of ten years, effective August 11, 2003 and imposed fines of $2000 each for having refused to permit an inspection of records and practices, as provided by Chapter 4, Section 7 of the Rules Applying to Registration and Discipline:

Dr. Davies gave the Events and Clubs Committee Report on fines assessed clubs for late submission of date applications and judges panels.
It was moved by Dr. Battaglia, seconded by Ms. Scully and VOTED (unanimously) to approve the Delegate credentials of the following persons, whose credentials have been published in two consecutive issues of the GAZETTE:

Following a motion by Mrs. Strand, seconded by Dr. Battaglia, it was VOTED (unanimously) to approve the membership applications from the Parson Russell Terrier Association of America and the Sagehen's Retriever Club, both of which will be voted at the September 2003 Delegates meeting.
The Board considered a proposal for a rule change amendment that would permit spayed bitches and castrated dogs to compete in non-regular classes at independent specialty shows. Following a motion by Mrs. Strand, seconded by Dr. Battaglia, it was VOTED (unanimously) to not adopt such an amendment.
The Board considered the requirement for listing of AKC Registered Handlers in the show catalog. Currently, the AKC Registered Handler is required to be listed in bold print. This is done in most cases, but not always when the Handler is also a co-owner. Following a motion by Mrs. Schaefer, seconded by Mr. Marden, it was VOTED (unanimously) to require that AKC Registered Handlers, who use their AKC handler number, be listed in bold print in show catalogs regardless of ownership of the dog. This will be effective for shows held after October 1, 2003.
The Board considered a policy governing the approval of breeds for retiring AKC employees. There was a motion by Mrs. Strand, seconded by Ms. Scully, to enable retiring employees that have met the following criteria to apply for up to one group or 26 breeds:
- Must have at least five years employment at AKC holding a position directly involving conformation dog show judges, or meeting basic criteria.
- Must have been a judge or met the requirements to become a judge prior to joining the AKC.
- Must pass mandatory procedure and anatomy exams and breed standard tests.
- Must pay the necessary application processing fee.
There was a motion by Mr. Gladstone, seconded by Mr. Merriam, to amend the above motion by changing the five years in number to ten years. This motion was defeated with the VOTE (affirmative, Mr. Gladstone, Mr. Merriam, Mrs. Schaefer, Dr. Mays, Dr. Battaglia; opposed, Mr. Marden, Mrs. Strand, Ms. Scully, Mr. Goodman, Dr. Garvin, Dr. Haines, Dr. Davies, Mr. Menaker).
The main motion was then VOTED (affirmative, Mr. Marden, Mrs. Strand, Ms. Scully, Mr. Goodman, Dr. Garvin, Dr. Haines, Dr. Davies, Mr. Menaker, Mrs. Schaefer, Dr. Battaglia, Dr. Mays; opposed, Mr. Merriam, Mr. Gladstone). The process will be applied retroactively to any employee who has retired since the implementation of the 1999 Judging Approval policies.
The committee also considered requiring the use of the AKC logo in Premium Lists, the eligibility of the Neapolitan Mastiff to compete in the Working Group, and Points for Reserve at one National Specialty for each breed each year.
The Board considered a request from the English Springer Spaniel Field Trial Association to increase the prerequisites for judges of English Springer Spaniel Field Trials. Currently, new judges must have completed two Open or Amateur apprentice judging assignments. Following a motion by Dr. Davies, seconded by Mrs. Strand, it was VOTED (unanimously) to make the requirement two Open and two Amateur apprentice judging assignments, effective October 1, 2003.
The committee also considered permitting Standard Schnauzers and Giant Schnauzers to compete in Herding events and the adoption of Rally Obedience as a licensed event.
There was discussion on Herding titles that were issued in error due to a programming error. The Board reviewed the specifics on 18 titles that were granted even though the dogs were short of the requirements. There was consideration given to referring the issue to a Delegate Committee. However, as the errors had been brought to AKC's attention by the Herding fancy, and as so many of the dogs were so far below the requirements for the title that the owner had to know, the matter was referred back to staff to proceed with rescinding the erroneous titles.
Dr. Battaglia gave a report from the Operations and Planning Committee.
The Board considered the criteria for granting a Registered Kennel Name. The following requirements are under consideration:
- The applicant(s) must be a breeder in good standing with The American
Kennel Club, whose record of breeding and registering dogs identifies
the applicant as a serious hobby-breeder, whose breeding activities
are non-commercial, and whose past registration practices have been
satisfactory to The American Kennel Club and in conformity with its
rules and regulations.
- The applicant(s) must not have an interest in a pet store. Kennel
owners with an interest in dog dealerships or pet stores will not be
granted a Registered Kennel Name nor will USDA licensed breeders.
- The applicant(s) must have bred at least 5 registered litters in
the past 5 years or have owned stud dogs that produced at least 40 registered
litters in the past 10 years.
- The kennel name is limited to 15 letters and may be a maximum of two
words. The only permitted punctuation is a hyphen.
- The Kennel name may not have been used more than incidentally
and rarely by other breeders or owners in naming dogs in the past 5
years.
- Unacceptable words in the kennel name would include, but are not
limited to, conflicts either phonetically or in spelling with: the name
of a breed, AKC titles, names of cities, family
names, corporations or trade names, as well as the names of very famous and universally recognized persons, living or dead, words commonly used in the naming of dogs. The name may be a unique word created by the applicant. The kennel name may not contain any derogatory or discriminatory words.
- The American Kennel Club reserves the right to reject an application.
- An individual applicant, who is a hobby breeder, but who does
not meet the requirements in 3 above, may be granted a name on a five-year
provisional basis. If at the end of the five years these requirements
have still not been met, the registration of the name would not be renewed.
- Registered Kennel Names granted on or after July 1, 2004 are granted on a breed-specific basis. An applicant may request the name to cover multiple breeds, but the applicable fee would be required for each breed requested and the above criteria would apply to each.
"Dur-Bet" registered to Elizabeth Durland in 1989.
"Heyday" registered to Dr. and Mrs. Clarence A. Smith in 1949.
"Silver Maple Farms" registered to Lee and Ruth Kraeuchi in
1936.
The committee also considered: possible revisions to the policy governing the retirement of registered kennel names and placing limited restrictions on prominent kennel names that had never been registered; a possible rule change to permit dog name changes on a limited basis; recommendations by the DNA Advisory Committee and the High Volume Breeders' Committee.
Mrs. Strand gave a report from the Public Relations and Public Affairs Committee.
The Board considered the addition of inspectors to the Compliance Division. The recommendation from the High Volume Breeders' Committee was intended to assure more complete coverage of kennels and to give AKC the ability to respond appropriately to high profile emergency cases. This matter was referred to staff, which is to report to the Board on how two more inspectors would benefit AKC's inspection program..
The Board considered legislative and regulatory initiatives recommended by the High Volume Breeders' Committee. Following a motion by Ms. Scully, seconded by Mr. Gladstone, it was VOTED (unanimously) to direct staff to work more closely with USDA and other relevant regulatory agencies. The Compliance Division and the Canine Legislative Department would benefit from such participation and cooperative efforts would aid enforcement of the Animal Welfare Act.
The Board discussed the concept of a Breeders' Department at AKC. The department would create, maintain and deliver informational and educational resource materials on canine husbandry and responsible breeding practices. It would be a resource for specialized or commonly misunderstood issues related to breeding; collecting and maintaining information, and in some cases recommending funding selected studies. It would develop hallmarks or criteria for recognizing responsible breeders and it would create a delivery system for this information that would enable the general public to recognize a responsible breeder. Materials should be prepared for print and Internet distribution, for the media and for presentation at seminars. Once the department is operational, it should create a "help line" for AKC dog owners for issues related to raising and training puppies. This help line would also serve as a portal for introduction to information of any kind about AKC activities and participation opportunities.
Following a motion by Dr. Garvin, seconded by Mr. Goodman, it was VOTED (unanimously) to approve this concept and the development of a concrete proposal for the Board to consider.
Dr. Haines raised the issue of AKC's policy on correcting pedigrees using DNA for dogs whelped before January 1, 2000. After some discussion, staff was directed to review the matter and to report back to the Board.
Dr. Mays made the recommendation that AKC consider adding a veterinarian to staff, with the job functions split between AKC and the AKC Canine Health Foundation. This individual's compensation could also be divided between the two organizations. It was agreed that this will be considered further.
Mrs. Schaefer raised the issue of the need for strategic planning and the various ways to achieve it. This subject was discussed at length.
There was also discussion on the best way to utilize expertise within the Delegate body. One recommendation was to establish a restricted internet site that Delegates could use to create and update personal files.
The committee also discussed AKC booth coverage at Trade Shows and the AKC policy on Banners and Signs.
