AKC Board Minutes
April 2003

The Board convened Monday, April 7, 2003 at 11:15 a.m. after the meetings of the various Board Committees. All Directors were present except Dr. Mays, who participated by telephone conference during the meeting. The Chief Operating Officer and Executive Secretary were also present.

The Board reviewed the February 2003 minutes. Upon motion made by Dr. Davies and seconded by Dr. Battaglia, the minutes of the February 2003 meeting, copies of which were made available to all Directors, were adopted (unanimously; absent, Dr. Mays).

There was an Executive Session to discuss personnel matters.

The President, Mr. Cheauré, reported on the roll out of the Pet Insurance program.

The President reported on the status of the registration reengineering.

Mr. Stevens gave a financial update. The Financial Report for the first quarter of 2003 showed total revenue of $13.7 million and a net deficit of $1.2 million after all expenses.

The individual registration figures for March 2003 are 70,000, versus 100,002 for March 2002.

The litter registration figures for March 2003 are 26,588, versus 37,790 for March 2002.

Following a report by Mr. Stevens, there was a motion by Mr. Marden, seconded by Mrs. Schaefer, and it was VOTED (unanimously; absent, Dr. Mays) to adopt the following resolution:

RESOLVED, that Circle Trust be removed as Trustee of The American Kennel Club 401(k) Tax Deferred Savings Plan, effective June 1, 2003; and

FURTHER RESOLVED, that Fidelity Management Trust Company be appointed as Trustee of The American Kennel Club 401(k) Tax Deferred Savings Plan, effective June 1, 2003.

Following a motion by Mr. Menaker, seconded by Ms. Scully, it was VOTED (unanimously; absent, Dr. Mays) to adopt the following resolution:

AT A MEETING OF THE BOARD OF DIRECTORS
OF
THE AMERICAN KENNEL CLUB

Held on April seventh, two thousand and three, the following Resolution was unanimously- absent, Dr. Mays-adopted:

WHEREAS, Robert L. Kelly was elected a Director of The American Kennel Club on March ninth, nineteen hundred and ninety-nine, serving until March eleventh, two thousand and three; and,

WHEREAS, he served on the Board Audit, Public Relations and Public Affairs, and Operations and Planning Committees in nineteen ninety-nine and two thousand; and,

WHEREAS, he served on the Board Business, Events and Clubs, and Employees Pension Committees in two thousand and one, two thousand and two and two thousand and three; and,

WHEREAS, he served on and made major contributions to the ad hoc Board-appointed DNA Advisory Committee and High Volume Breeders Committee; and,

WHEREAS, he has served the important role of Board liaison to both the Dog Show Rules and the Herding, Earthdog and Coursing Standing Delegate Committees; and,

WHEREAS, his acknowledged expertise in matters pertaining to sound business practices, and the needs and wishes of participants in all facets of the Sport have proved to be invaluable assets to the Board as it addressed the organization's financial position and issues related to various types of dog events; and,

WHEREAS, we are ever mindful of the great contributions he has made and continues to make to The American Kennel Club and the Sport of Purebred Dogs; and,

WHEREAS, we will miss his sound judgment, good humor, and extensive knowledge of the Sport; and,

WHEREAS, we will ever cherish our association with this distinguished sportsman, businessman, and friend;

NOW THEREFORE, be it

RESOLVED, that the Directors of The American Kennel Club extend to him their most sincere best wishes for the years ahead and their deep appreciation for his many years of dedicated service to The American Kennel Club.

The Executive Secretary, Mr. Crowley, reported on a request submitted by the Doberman Pinscher Club of America for permission to hold a Schutzhund demonstration at its October 2003 National Specialty. Following a motion by Dr. Davies, seconded by Dr. Battaglia, it was VOTED (unanimously; absent, Dr. Mays) to approve this request with the understanding that the Doberman Pinscher Club of America had control over and complete responsibility for the event.

Following completion of the report on Judges Applications, Mr. Merriam, Mr. Marden and Dr. Haines returned to the meeting.

There was a report on the actions taken by the AKC staff during the month of March 2003 on the cancellation of litters and individual registrations.

During the month of March, the registrations of 10 litters were cancelled: 5 because of impure breeding, 1 at the request of the litter owner(s) and 4 as a result of DNA Parentage Evaluation.

The cancellation of the 10 litters resulted in the cancellation of 12 registered dogs and rendered 29 dogs, members of these litters, ineligible for registration.

The Board considered a clarification of the Misconduct Guidelines as they pertain to misconduct against a judge. Following a motion by Mr. Merriam, seconded by Dr. Garvin, it was VOTED (unanimously; absent, Dr. Mays) to adopt the following guidelines (changes underlined):

The following actions taken by the AKC Management Disciplinary Committee were reported:

Richard Thomas (Las Vegas, NV) was suspended by the Kennel Club of Palm Springs for having a verbal altercation with the club's traffic control coordinator at its January 4, 2003 show. The AKC Management Disciplinary Committee imposed a suspension of one month, effective January 29, 2003, and a $500 fine.

Tina McDonnell (Colfax, NC) was suspended by the Conyers Kennel Club of Georgia at their event on February 1, 2003, for disregard of published club regulations in that she failed to properly supervise her son, who damaged the restroom. The AKC Management Disciplinary Committee imposed a $100 fine and a public reprimand.

Linda Tabor (Arlington, TX) was suspended by the San Antonio Kennel Club for conduct at their event on March 8, 2003 for mistreatment of a dog at an event in that she left her Siberian Husky in a crate that was too small. The AKC Management Disciplinary Committee acted to issue a letter of reprimand and imposed a $100 fine.

The AKC's Management Disciplinary Committee has suspended the following individuals from all AKC privileges for a period of ten years, effective April 7, 2003, and imposed fines of $2000 each for failure to comply with the recordkeeping and identification requirements of Chapter 4 of the Rules Applying to Registration and Discipline. Further, reinstatement will be contingent upon their beginning with a new colony:

The AKC's Management Disciplinary Committee has suspended Mabel Covington (Antioch, TN) from all AKC registration privileges for a period of three (3) months, effective April 7, 2003, and imposed a $1000 fine for having submitted, or caused to be submitted, registration certficates, which she knew, or should have known, did not have the signature of her co-owner. (German Shepherd Dog)

The AKC's Management Disciplinary Committee has suspended Ike Hilton (Cross, SC) from all AKC privileges for a period of six (6) months, effective April 7, 2003, and imposed a $500 fine for having submitted, or caused to be submitted, two litter registration applications, which he knew, should have known, or had a duty to know, contained exclusions. (Multiple Breeds)

The AKC's Management Disciplinary Committee has suspended Saundra Pruitt (Bentonville, AR) from all AKC privileges for a period of one (1) year, effective April 7, 2003, and imposed a $1000 fine for failure to maintain her dogs and facilities in a manner acceptable to The American Kennel Club. (Multiple Breeds)

The AKC's Management Disciplinary Committee has suspended Sarah Whitlowe (McAlester, OK) from all AKC privileges for a period of six (6) months, effective April 7, 2003, and imposed a $500 fine for having submitted, or caused to be submitted, two litter registration applications, which she knew, should have known, or had a duty to know, contained exclusions. (Yorkshire Terrier)

The AKC's Management Disciplinary Committee has suspended Don Young II (Castro Valley, CA) from all AKC registration privileges for a period of one (1) year, effective April 7, 2003, and imposed a $1000 fine for having reported false information in connection with two certificates of transfer. (Gordon Setter)

Dr. Davies gave the Events and Clubs Committee Report on fines assessed clubs for late submission of date applications and judges panels.

Following a motion by Mrs. Strand, seconded by Mr. Merriam, it was VOTED (unanimously; absent, Dr. Mays) to approve the revised Greater Swiss Mountain Dog Breed Standard as published in the GAZETTE, effective May 29, 2003.

Following a motion by Mrs. Strand, seconded by Mr. Menaker, it was VOTED (unanimously; absent, Dr. Mays) to approve a request from the Irish Setter Club of America to modify the eligibility requirements for its National and National Amateur Championship. The request eliminates tattoos as one of the means of identification. The new criteria reads:

"All dogs entered in the National and/or National Amateur Championship are required to have an AKC DNA profile and be identified with a microchip implant."

Charleston Kennel Club and Myrtle Beach Kennel Club have historically shared weekends. The fall weekend has been held in the Myrtle Beach Kennel Club territory. Myrtle Beach Kennel Club moved their fall site to Lake Waccamaw, NC. While the move to Lake Waccamaw, NC had no negative effect on Myrtle Beach Kennel Club, it took Charleston Kennel Club over 100 miles out of their (Charleston) territory. When the issue was discovered, Myrtle Beach Kennel Club attempted to move back to their historic site only to find that the site had been secured by someone else. Charleston Kennel Club then attempted to secure the club's January site only to find that the site had been rented to another party. At this time, there are no available sites within Charleston Kennel Club's territory and the club has requested a "one-time" approval to hold their September 2003 event in Lake Waccamaw, NC. Charleston Kennel Club has contracted the January site to hold back-to-back events in 2004 and forward. Following a motion by Mr. Goodman, seconded by Mrs. Strand, it was VOTED (unanimously; absent, Dr. Mays) to approve this request on a one-time basis.

Following a motion by Dr. Davies, seconded by Mr. Goodman, it was VOTED (affirmative, Dr. Davies, Mr. Goodman, Dr. Garvin, Dr. Haines, Ms. Scully, Mrs. Strand, Mrs. Schaefer, Mr. Marden, Mr. Merriam, Dr. Battaglia, Mr. Menaker; abstaining, Mr. Gladstone, absent, Dr. Mays) to add the following paragraph to Chapter 1, Section 17 of the Retriever Hunting Test Regulations, which would require clubs to split the Master and Senior level tests when a specified number of entries are received:

Revise Chapter 1, Section 17 by adding the following new paragraph:

When entries exceed a total of sixty (60) dogs at the Master level during a two (2) day event, or any division thereof, the Master level must be split to run in two or more divisions. When entries exceed a total of ninety (90) dogs at the Master level during a three (3) day event, the Master level must be split in two or more divisions. When entries exceed a total of fifty (50) dogs at the Senior level and the test is scheduled to run only one day, then the test must be split in two or more divisions.

The Events and Clubs Committee also discussed the AKC banner and sign policy, policies governing evening specialties after all-breed shows, the water test requirement for Cocker Spaniels and English Cocker Spaniels at AKC Field Trials, an owner-handler stake for Retriever Field Trials, handling a dog on a mark in a Derby Stake at a Retriever Field Trial, age requirements for Performance Event judges and the possibility of FSS enrolled dogs competing in some Companion and Performance events.

Mr. Merriam gave the report of the Board Appeals Committee. The committee recommended and the Board VOTED to grant the following breeds:

Dr. Ralf J. Graff - Akitas, Bernese Mountain Dogs, Great Pyrenees, Greater Swiss Mountain Dogs, Mastiffs

Mr. Merriam gave the report from the Business Committee.

The Board discussed the cost of the Events Department and the necessity for the users and beneficiaries of AKC services to share in at least a portion of these costs. Various options and amounts were carefully considered. There was a motion by Dr. Battaglia, seconded by Mrs. Schaefer to impose a $1.50 AKC Event Service Fee for the first entry of a dog in all AKC licensed and member dog shows, obedience trials, tracking tests, field trials, and hunting tests. The motion also stipulated that the recording fees were to continue to be collected.

For performance events with a $1.00 recording fee, there would be a $1.00 AKC Event Service Fee collected. As there is currently a $3.00 recording fee collected for Agility, Earthdog, Herding, and Lure Coursing Events, there would be no AKC Event Service Fee imposed.

There was a motion by Mr. Gladstone, seconded by Dr. Garvin to exclude entries in the Bred-by-Exhibitor Class. This motion was defeated with the VOTE (Affirmative, Mr. Gladstone and Dr. Garvin; Opposed, Mr. Merriam, Mrs. Strand, Mr. Marden, Mr. Goodman, Dr. Battaglia, Dr. Davies, Mrs. Schaefer, Ms. Scully, and Dr. Haines; Abstaining, Mr. Menaker; Absent, Dr. Mays). The main motion was then VOTED (unanimously; absent, Dr. Mays) with an effective date for events held on and after January 1, 2004.

Following the vote, there was a consensus that it was the intent of the Board to meet future revenue shortfalls in the area by attempting to find alternative revenue and by instituting additional cost savings where possible.

Mr. Merriam also indicated that the committee was considering the subject of superintendent and event secretary fees and looking at the whole range of event-related fees.

Dr. Battaglia gave a report from the Operations and Planning Committee.

Dr. Battaglia reported that the committee was reviewing the policies governing kennel names, the judging approval system, the addition of two foreign registries to AKC's registration list (Byelorussia and Ecuador), an arbitration provision for AKC entries, and a reduction in fees for Open Registration.

Mrs. Strand gave a report from the Public Relations and Public Affairs Committee.

There was a discussion on the boilerplate information included in many AKC publications and releases. There was a motion by Ms. Scully, seconded by Dr. Haines, to adopt the following boilerplate wording:

Mr. Crowley reported on a request from the Delegate Parent Clubs Committee for a grant of up to $100,000 to help to finance a 2004 Parent Clubs Conference. Following a motion by Mrs. Strand, seconded by Dr. Garvin, it was VOTED (affirmative, Mrs. Strand, Dr. Garvin, Mr. Menaker, Dr. Haines, Mrs. Schaefer, Mr. Marden, Ms. Scully, Dr. Battaglia, Mr. Goodman, Dr. Davies, Mr. Gladstone; opposed, Mr. Merriam; absent, Dr. Mays) to approve this grant.

Mr. Marden reported on the recently held AKC Gun Dog Championship. He was very complimentary of the job done by both the host club, the German Shorthaired Pointer Club of Middle Tennessee, and the AKC field staff.

There was a workshop to discuss the judging approval process.

The meeting reconvened and was adjourned at 5:15 p.m., Tuesday, April 8, 2003.
The Board reconvened, Wednesday, April 9, 2003, at 8:00 a.m. All Directors were present, except Mr. Cheauré. Dr. Mays participated by telephone conference. The Chief Operating Officer and Executive Secretary were also present.

The Board went into a workshop session to discuss the judging approval process and the High Volume Breeders Committee Report.
